Keshena, Wis. (UPI) - Negotiations between a religious order and an unarmed band of Indians who took over a closed monastery early New Year's Day apparently broke off today and non-Indian personnel began leaving the 37-acre site. Judge Gordon Myse of Appleton, who had entered the monastery Wednesday and remained overnight emerged at about 10 a.m. and said negotiations had been unsuccessful. Also leaving the compound were Gene Linehan, an attorney for the Indians, John Murdagah, an attorney for the Indian Legal Services and Neal Hawpetoss, 27, Keshena, chief spokesman for the group. The site has been sealed off by county, state and federal officials and the Indians have said they are ""prepared to die for what we believe in."" Hawpetoss said there were about 400 Indians inside they facility, but Myse said there were about 50, including women and children. The Indians moved into the monastery early Wednesday morning and said they are demanding that the religious order turn the land over to them. They said laws made by white men provide that the facility be returned to the Indians if it is no longer in use as a educational or religious institution. Hawpetoss and Murdahah entered the monastery at about 8:30 a.m. and remained for about 45 minutes. A short time later Myse emerged. He went immediately to the courthouse and into conference with authorities. Hawpetoss Wednesday has said the Indians were ""holding the Alexian Brothers responsibile for the lives and safety of our people in the monastery."" The group taking over the facility calls itself the ""Menominee Warrior Society."" The Alexian Brothers of America owned the site and used it as a novitiate until 1968. Authorities said shots had been fired, but not by law enforcement officers. Hawpetoss denied that Indians fired any shots. He said the Indians were armed with ""bows and arrows."" Another Indian spokesman said they only had ""some hunting equipment."" But the caretaker of the facility, Joe Plonka, said when the Indians arrived they were carrying ""plenty of handguns and shotguns."" Plonka said they fired ""pot shots at passersby."" There were no reports of injuries. Plonka, his wife and their two children were ejected from the monastery about two hours
