F TA BOX 336 LOU KY 40201 Dear Friends As this issue of FTA and the enclosed reprints mention the Ft. Knox Coffee House is under heavy attack. We started this place because we saw it as important in our fight for Respect, for Our rights, and for an end to the War and Racism. From the responses in the short time we were open and from the rally on the 28th we proved we were right. The Brass and local officials are doing everything to get rid of us. They have used harassment, court actions and even a specially passed ordinance. We are fighting back. The GIs and staff have stood up to the harassment well. The rally of the 28th was a tremendous success. The large attendance, over 200 GIs and local community folk, forced the police to backdown from their arrest threats, and established our right to be open. We are also attacking their phony ordinance in the Federal Courts. But the major challange remains before us. The forceable detainer hearing of the 24th and 25th has not yet been decided. Legally the only grounds this writ can go against us is for non-payment of rent. Our trial lasted two days covering 350 pages of testimony yet the prosecution never attempted to prove non-payment. Instead they spent all their time delving into the purpose and politics of the Coffee House. Our lawyers continually objected to this as totally irrelevant but the Judge overruled any objection or motion we made. So we laid it on them, as the press coverage shows. After the prosecution made its "case" we moved that the charges be droped since they hadn't even proved a Prima Facia case. In fact the landlord admitted we had offered him the rent which he refused. But it made no difference to the Judge. Although he made no decision, saying he would think about it, it's been clear from the start he has no intention of ruling in our favor. It is obvious that they thought they could use the hearing to rally local people against us to justify a phony legal ruling. But it backfired. Un fort- unatly they still hold a trump card. When the Judge rules against us, as he probably will, it will force us to appeal. We can win the appeal, but the question is will we ever get a chance to make that appeal. Inorder to apeal we must post a Traverse Bond within 3 (three) days of the ruling. A Traverse Bond is three times our rent times the reasonable length of our appeal (six months). That means we will have to post about $4500.00 cash within three days notice. We have been frantically trying to raise money or secure loans to cover the anticipated Bond. We have made progress but have a ways to go yet. We need your help. Many of you have contributed generously in the past. Many of you helped with Contribution-Subscriptions a number of months ago. We hope that you will renew your subscriptions now and add as much extra as possible to keep us alive and fighting.
